This Privacy Policy explains how Along the Path Ltd, Ireland, operating the Along the Path™ and ATP Kinesiology services (“Along the Path Ltd”, “we”, “us” or “our”), collects, uses, stores, shares and protects personal data in connection with our websites, courses, workshops, retreats, events, practices, consultations, kinesiology and wellbeing services, online learning and related services.

We respect your privacy and seek to handle personal information carefully, transparently and only for appropriate purposes.

We process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR), the Irish Data Protection Act 2018 and other applicable Irish and European data-protection and electronic-communications legislation.

Along the Path Ltd operates two principal service areas:

Along the Path™ provides training, courses, workshops, retreats, events, practices, online learning, memberships, consultations and related educational, experiential, wellbeing and personal and spiritual development services.

ATP Kinesiology

ATP Kinesiology provides kinesiology, wellbeing, coaching and related individual client services.

The service is presented through two language-specific websites:

These are different language versions of the ATP Kinesiology service and do not represent separate data controllers.

Along the Path Ltd is the data controller for the personal data described in this Privacy Policy in connection with Along the Path™, ATP Kinesiology and the websites and services listed above.

2. Personal data we may collect

Depending on how you interact with us and which service you use, we may collect:

  • your name and contact details;
  • email address;
  • telephone number;
  • postal or billing address;
  • date of birth where relevant to the service;
  • registration and booking information;
  • course or programme participation information;
  • online course and account information;
  • course progress or completion information;
  • payment and transaction information;
  • invoice and billing information;
  • communications with us;
  • information voluntarily provided through forms, questionnaires, consultations or appointments;
  • technical website, device and browser information;
  • cookie, analytics and similar technology information where applicable; and
  • other information reasonably necessary to provide the service you request.

We seek to collect only personal data that is reasonably necessary and relevant for the particular purpose.

3. Course, training and event information

If you participate in an Along the Path™ course, workshop, retreat, event, practice or online programme, we may process information relating to:

  • your registration;
  • courses or programmes purchased;
  • attendance;
  • course access;
  • learning-platform accounts;
  • course progress;
  • communications concerning the programme;
  • participation in online or in-person activities;
  • certificates or completion information where applicable; and
  • other information reasonably required to administer your participation.

4. Health and participation-safety information

For some courses, workshops, retreats or practices, we may ask you to provide limited health or safety-related information where reasonably necessary to assess participation considerations, adapt an activity, respond appropriately in an emergency, or help provide a safe learning environment.

We do not request more health information than is reasonably necessary. Where such information constitutes special-category personal data, we process it only where an appropriate legal basis and Article 9 condition applies, which may include your explicit consent.

Along the Path™ programmes are educational and experiential personal and spiritual development programmes and are not a substitute for medical diagnosis, treatment, psychotherapy or other regulated healthcare services.

5. ATP Kinesiology client and health information

If you use ATP Kinesiology or related individual wellbeing services, we may collect information that you voluntarily provide before, during or after a consultation or appointment.

Depending on the service, this may include:

  • the reason for your consultation;
  • health and wellbeing information;
  • symptoms, concerns or goals;
  • relevant medical history;
  • medications or treatments where relevant;
  • lifestyle information;
  • information provided during a consultation;
  • session observations and notes;
  • agreed actions or recommendations;
  • appointment history; and
  • communications concerning your sessions.

Some of this information may constitute data concerning health and therefore special-category personal data under Article 9 GDPR.

We seek to collect only information reasonably relevant to the service being provided and apply additional care to the storage and handling of health-related information.

ATP Kinesiology and related wellbeing services are complementary wellbeing services and are not a substitute for emergency medical care or other healthcare services where such care is required.

6. Special-category personal data

Information concerning health, religious or philosophical beliefs and certain other information may be special-category personal data under the GDPR.

We process such information only where permitted by law and apply additional care appropriate to its sensitivity.

Where ATP Kinesiology or another service requires us to process health information, we will have both an appropriate Article 6 lawful basis and an applicable Article 9 condition.

Where appropriate, we may ask for your explicit consent under Article 9(2)(a) GDPR to process health or other special-category information for specified purposes.

Where processing is based on explicit consent, you may withdraw that consent. Withdrawal does not affect the lawfulness of processing already carried out before withdrawal and does not require deletion of information that we are permitted or required to retain under another applicable legal basis.

Health information is not used for unrelated advertising or marketing purposes.

7. Religious, philosophical and spiritual information

Our programmes may discuss spiritual, philosophical, contemplative or traditional concepts. Participation does not require adherence to any religion, spiritual tradition or belief system.

If you voluntarily disclose information revealing religious or philosophical beliefs, we treat it with appropriate care and, where it constitutes special-category personal data, process it only where permitted by law.

8. Information shared during programmes

Participants may choose to share personal experiences during courses, workshops, retreats, consultations or group practices. We ask participants to respect the privacy and confidentiality of others.

However, Along the Path Ltd cannot guarantee that another participant will maintain confidentiality, so participants should use their own judgement when deciding what to share in a group setting.

9. How we use personal data

Depending on your relationship with us, we may use personal data to:

  • process registrations, bookings and payments;
  • provide courses, workshops, retreats, consultations, kinesiology and other services;
  • manage online course accounts and access;
  • communicate about bookings or participation;
  • manage participant safety and practical arrangements;
  • maintain appropriate client, participant and service records;
  • maintain business, accounting and administrative records;
  • respond to enquiries and provide support;
  • manage our websites and technical systems;
  • maintain the security and integrity of our websites and online services;
  • protect our training materials and intellectual property;
  • prevent or investigate misuse of course access;
  • improve our services and understand website use;
  • send newsletters or marketing communications where we have an appropriate lawful basis; and
  • comply with legal and regulatory obligations.

10. Legal bases for processing

The legal basis we rely upon depends on the particular processing activity and the circumstances.

Contract – Article 6(1)(b) GDPR

We may process personal data where necessary to enter into or perform a contract with you, including to process registrations, provide purchased services, administer courses or appointments, manage course access, process transactions and communicate with you about the service you requested.

Legal obligation – Article 6(1)(c) GDPR

We may process personal data where necessary to comply with legal obligations, including accounting, taxation, financial record-keeping and lawful requests from competent authorities.

Legitimate interests – Article 6(1)(f) GDPR

Where appropriate, we may process personal data where necessary for our legitimate interests, provided those interests are not overridden by your rights and freedoms.

These interests may include:

  • operating and improving our services;
  • responding to enquiries;
  • maintaining website, account and course security;
  • preventing fraud and misuse;
  • protecting our intellectual property;
  • protecting course and training materials against unauthorised distribution;
  • investigating suspected misuse;
  • maintaining appropriate business and administrative records; and
  • establishing, exercising or defending legal claims.

Consent – Article 6(1)(a) GDPR

We rely on consent where appropriate, including for newsletter and electronic marketing communications where consent is required, optional promotional use, non-essential analytics technologies and other optional processing for which consent is requested.

Where special-category personal data is involved, we also require an applicable Article 9 condition, which may include explicit consent.

11. Course access and personalised video watermarking

Certain Along the Path™ digital courses and protected training materials may use personalised identification and watermarking measures.

Before accessing protected material, you may be asked to provide or confirm your name and the email address used for your course registration.

We may use this information to:

  • identify or verify course access;
  • associate course access with an individual participant;
  • protect our training materials and intellectual property;
  • discourage unauthorised copying, screen recording, sharing or redistribution;
  • investigate suspected unauthorised use or distribution; and
  • maintain the security and integrity of our online learning services.

Your name and/or a partially masked version of your email address may be displayed as a personalised watermark over protected video content while you watch it.

Where personalised course-video watermarking is used, we may rely on our legitimate interests in protecting our intellectual property, course-access arrangements and training materials against unauthorised copying, recording, sharing or distribution, subject to applicable data-protection requirements.

We do not use personalised watermark information to make automated decisions producing legal or similarly significant effects.

12. Photographs, video and audio recordings

We may take photographs, video or audio recordings at certain events only where there is an appropriate legal basis and participants have been appropriately informed.

Where consent is required for identifiable promotional material, participation itself does not automatically constitute consent.

Participants must not make covert or non-consensual recordings of other participants, instructors or private programme activities.

The personalised watermarking of protected online course material described in Section 11 is an access-protection measure and is separate from consent relating to photographs or recordings used for promotional purposes.

13. Newsletter and direct marketing

Registration for an Along the Path™ programme or ATP Kinesiology service does not automatically subscribe you to marketing communications.

Where required, newsletter or marketing consent is obtained separately and remains optional.

You can unsubscribe at any time using the unsubscribe facility provided in the communication or by contacting us.

Withdrawal of marketing consent does not prevent necessary transactional or service-related communications concerning a course, booking, appointment, purchase or other service you have requested.

We do not sell our mailing lists or personal data to third parties.

14. Cookies, browser storage and similar technologies

Our websites and online services may use cookies, browser local storage and similar technologies to operate the websites, provide requested functionality, maintain sessions, remember appropriate user choices, support course-access functionality, protect security and—with your prior consent where required—analyse use of our websites.

Where consent is legally required before placing or accessing information on your device, we seek that consent before using the relevant technology.

Technologies that are strictly necessary to provide a service expressly requested by you may be used without consent where permitted by applicable law.

Where browser storage is used in connection with protected course access or personalised video functionality, it may be used to remember relevant verification or access information on your device. The applicable storage and retention arrangements will be handled in accordance with applicable electronic-communications and data-protection requirements.

15. Google Analytics

Our websites may use Google Analytics to help us understand how visitors use our websites.

Google Analytics may use analytics cookies and related technologies to process statistical information such as visits, pages viewed, sessions, approximate geographic area, device and browser type, and interactions with the website.

Google Analytics and other non-essential analytics technologies are activated only after your prior consent where consent is required.

Refusing analytics consent does not prevent you from using the essential functions of our websites.

Google provides the Google Analytics service. Use of the service may involve international transfers of personal data; where applicable, such transfers are handled in accordance with the international-transfer provisions of this Privacy Policy and applicable data-protection law.

16. Payments and financial information

Where you purchase a service, course or programme, we may process transaction, payment-status, billing and invoice information required to administer the transaction and comply with accounting and taxation obligations.

Electronic card payments may be processed by third-party payment providers such as Stripe. Where payment details are entered directly into the payment provider's system, we do not normally receive or store your complete payment-card details.

17. Sharing personal data

We do not sell your personal data.

We may share personal data where reasonably necessary with:

  • service providers acting on our behalf;
  • website and online-course providers;
  • email and communication providers;
  • payment providers;
  • accounting and invoicing providers;
  • IT, cloud, hosting and security providers;
  • instructors or contractors involved in delivering a service, where appropriate;
  • professional advisers;
  • insurers where appropriate; and
  • public authorities where disclosure is required or permitted by law.

Where another organisation acts as a processor on our behalf, we seek to ensure that appropriate data-protection arrangements apply.

18. Third-party service providers

We may use third-party providers for website hosting, online forms, course delivery, email communications, analytics, payments, invoicing, administration, cloud services and other business functions.

Our Along the Path™ online services and course environment may use the Systeme.io platform, and we may use Google Analytics for website analytics subject to applicable consent requirements.

We may also use third-party payment, invoicing, communications, hosting and administrative providers where reasonably necessary to operate our services.

Some third-party providers may act as processors on our behalf, while others may act as independent controllers for particular processing activities. Their own privacy information may apply where they act independently.

19. International transfers

Some service providers may process personal data outside Ireland or the European Economic Area (EEA).

Where personal data is transferred internationally, we take reasonable steps to ensure that an appropriate lawful transfer mechanism or safeguard is used where required.

Depending on the circumstances, this may include a European Commission adequacy decision, applicable Standard Contractual Clauses or another recognised lawful transfer mechanism.

You may contact us if you require further information concerning the safeguards applicable to a particular international transfer.

20. How long we keep personal data

We retain personal data only for as long as reasonably necessary for the purposes for which it was collected, including contractual, administrative, accounting, tax, legal, safeguarding, insurance, intellectual-property protection and dispute-resolution requirements.

Course and programme records

Course registration, purchase and participation information may be retained for the duration of your participation and afterwards where reasonably necessary for course administration, proof of purchase, access management, certificates, intellectual-property protection, dispute resolution or legal claims.

ATP Kinesiology and health-related records

Health and consultation information is retained only for as long as reasonably necessary for the purpose for which it was collected and any applicable legal, professional, insurance, continuity, safeguarding or claims-related requirements.

We periodically review whether continued retention of such information is necessary.

Marketing information

Where marketing is based on consent, we process the relevant information for marketing until you unsubscribe or withdraw your consent.

We may retain limited suppression information afterwards so that we can respect your request not to receive further marketing.

Financial and tax records

Invoices, transaction records and other financial information are retained for the period required under applicable accounting and tax law.

General enquiries

Enquiries that do not result in an ongoing relationship may be deleted after a reasonable period once the information is no longer required.

When information is no longer required, we take reasonable steps to delete, anonymise or securely dispose of it.

21. Data security

We use reasonable organisational and technical measures designed to protect personal data against unauthorised access, accidental loss, alteration, disclosure or destruction.

Depending on the information and systems concerned, these measures may include access controls, authentication measures, secure service providers, restricted access to sensitive information, backups and appropriate organisational procedures.

We seek to limit access to personal data according to business need and the sensitivity of the information.

No internet-based or electronic system can be guaranteed to be completely secure.

22. Personal data breaches

If a personal data breach occurs, we will assess it and take appropriate action in accordance with applicable data-protection law.

Where a personal-data breach is likely to result in a risk to the rights and freedoms of individuals, we will notify the competent supervisory authority without undue delay and, where feasible, within 72 hours after becoming aware of the breach, where required by GDPR.

Where a breach is likely to result in a high risk to the rights and freedoms of affected individuals, we will also communicate the breach to those individuals without undue delay where required by law.

We will take reasonable steps to investigate, contain, remediate and document relevant incidents.

Subject to the conditions and exceptions provided by applicable law, you may have the right to:

  • access your personal data;
  • correct inaccurate or incomplete information;
  • request deletion of personal data;
  • restrict processing;
  • object to certain processing;
  • data portability where applicable;

  • object at any time to processing for direct marketing;
  • exercise applicable rights concerning automated decision-making; and
  • lodge a complaint with a supervisory authority.

These rights are subject to the conditions and exceptions provided by law. For example, the right to deletion is not absolute where information must or may lawfully continue to be retained.

24. Withdrawal of consent

Where processing is based on consent, you may withdraw that consent at any time.

Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Withdrawal of one optional consent, such as newsletter, promotional-use or analytics consent, does not automatically affect processing carried out on another lawful basis.

Similarly, withdrawing marketing consent does not prevent us from sending necessary transactional or service-related communications relating to a service you have requested.

We may need to verify your identity before responding to a request. We will respond within the period required by applicable law.

We are not responsible for the privacy practices of independent third parties acting as their own data controllers and recommend reviewing their privacy information before providing personal data to them.

28. Children and young people

Our general websites and services are not designed to collect personal data from children without an appropriate lawful basis and, where required, involvement or consent of a parent or guardian.

If a programme or service is specifically offered to a child or young person, appropriate registration, consent, safeguarding and privacy arrangements will be applied.

29. Automated decision-making and profiling

We do not currently make decisions producing legal or similarly significant effects on individuals solely through automated processing.

The use of automated technical functions for matters such as website operation, security, course access or personalised watermark display does not mean that we use automated systems to make legal or similarly significant decisions about participants or clients.

If our use of automated decision-making changes materially, we will provide the information required by applicable law.

30. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, technology, service providers, processing activities or legal requirements.

The current version will be published on our websites together with its latest update date.

Where a change materially affects the way we process personal data, we will provide additional information or notice where required by law.

Where we intend to use previously collected personal data for a new purpose, we will provide the information required by applicable law before beginning that further processing and obtain additional consent where consent is required.

31. Relationship with previous Privacy Policies

This Privacy Policy consolidates and updates privacy information previously issued by Along the Path Ltd in connection with Along the Path™ and ATP Kinesiology.

Personal data collected before the effective date of this version remains subject to applicable data-protection law and the lawful basis on which it was originally collected.

Updating this Privacy Policy does not by itself change an existing consent or create consent for a new processing activity where consent is legally required.

Where an existing client, participant or subscriber is affected by a material new processing purpose, we will provide appropriate information and, where necessary, obtain additional consent before undertaking that processing.
